Black Box Data Leads to Substantial Recovery for Marathon Runner
While on a Brickell sidewalking running and training for an upcoming marathon, Ms. L was hit by a car that had been propelled onto the sidewalk by a Lexus that struck that parked car. Ms. M suffered a serious fracture to her lower leg and required extensive surgery. The Lexus driver claimed that a phantom car had caused her to brake and swerve into the parked car. But PDM retrieved the Black Box data (Event Data Recording) from the Lexus. The Black Box revealed no swerving prior to impact and no braking whatsoever. Instead, the data revealed that the Lexus driver was inattentive and simply drifted into a parked car. PDM also tracked down witnesses in the blogosphere that were not on police report. Witnesses uniformly disputed the Lexus driver’s phantom defense.
