Miami Product Liability Claims: Three Types Of Defects That Could Entitle You To Compensation

According to the National Safety Council (NSC), close to 12 million people seek treatment in hospital emergency rooms each year for personal injuries suffered as a result of dangerous and defective products. Negligence on the part of product designers, manufacturers, and distributors is often to blame. Find out three common types of product defects and how to protect your rights to compensation.

Common Product Defects That Can Cause Serious Personal Injuries In Miami

Most of us are skeptical of advertising claims and have bought items that failed to live up to the hype. While they may not work as promised, we at least expect them to be safe. Unfortunately, this is not always the case.

The NSC reports that product defects are a common cause of personal injuries and can happen when using any type of consumer goods. Vehicles, sports or recreational equipment, electronics, furniture, home decor, clothing, medications, and cleaning supplies are among those that frequently pose major hazards to users, with older adults and young children being among the most common victims. There are three types of product defects that can put you and your loved ones at risk:

  • Design defects: These are defects that are inherent in the design of a product. Examples include power tools that lack safety guards, children’s toys with small parts, and furniture that is not structurally sound.
  • Manufacturing defects: These occur due to errors and oversights that occur in the production process. Examples include using subpar materials or otherwise cutting corners in terms of quality and safety to lower production costs.
  • Defects due to lack of instructions or warning labels: One of the most common types of product defects, this involves failing to make consumers aware of potential hazards and not providing basic guidance in terms of product assembly and use.

Protecting Your Rights To Compensation In A Product Liability Claim

Under the Florida Statutes, you have the right to hold designers, manufacturers, and distributors liable for personal injuries suffered as a result of dangerous and defective products in Miami. In filing a claim, you need to prove that the at-fault party had a duty of care in protecting your safety, that they breached that duty, and that you suffered losses as a result.

If you or someone you love is injured, take these steps to protect your rights to compensation:

  • Keep receipts, instructions, and warranties for products you purchase;
  • When injuries happen, take photos of the product and your injuries;
  • Seek immediate medical care;
  • Make sure medical records include how your injuries occurred;
  • Keep records concerning lost wages, medical expenses, and other costs you incur.
