PWD Obtains $975,000.00 Settlement For Injured Security Guard
Mr. Jones (FN – client’s real name not used) was working as a security guard stationed in a building in South Florida. One afternoon, the building’s engineer requested that Mr. Jones look into a complaint from a tenant that the air conditioning was malfunctioning. Mr. Jones went to the suite as requested. On arrival, he found the air conditioning was, in fact, not working. The Building’s engineer had also asked Mr. Jones to go into the electrical/mechanical room on that floor to determine whether the air handler was on — but did not ask him to touch any of the equipment.
As requested, Mr. Jones entered the electrical/mechanical room and, in fact, the air handler was not working. Mr. Jones — going above and beyond the call of duty — attempted to re-cycle a breaker box, which he believed controlled the air handler, by turning off and on the switch on the outside of the box. Unknown to Mr. Jones, the box he was touching actually controlled lighting on the floor. For unknown reasons, the action of exercising the box’s handle up and down caused an “arc blast.” The powerful blast knocked Mr. Jones to the floor. As a result, he sustained several injuries including to his neck and eye. Through hard work, dedication and faith, Mr. Jones made as good a recovery as he could and returned to work as soon as his doctors permitted him to do so. In the addition to resuming employment in the security industry, Mr. Jones is very active in his Church where he met his soon to be wife. Although the Defendant argued that Mr. Jones was “comparatively negligent” in contributing to the accident, PWD was able to settle the case for $975,000.00 before trial.
