PWD Recovers $1 Million in Trucking Case from Blanco Transfer
On June 1, 2017, Mr. Exposito, a trucker, picked up a loaded trailer from a vendor – Blanco Transfer — in Miami and headed to Sarasota. After getting off of I-75, Mr. Esposito executed a left turn. During the turn, the trailer and tractor overturned. The roll-over killed Mr. Exposito – dead at the scene.
Blanco Transfer claimed that Mr. Exposito simply made too sharp a turn. However, Mrs. Exposito knew her husband to be a good driver. So, she turned to PWD for help and to determine the truth. PWD’s Skip Pita took charge of the case. Immediately, PWD had the truck and trailer preserved, and then took a trucking and engineering expert to investigate. That investigation discovered that 3 out of the 4 brakes on the trailer were well out of specification and did not provide any braking force. Gouge marks in the asphalt showed the trailer overturned first.
PWD sued. Despite the mechanical and physical evidence, Blanco Transfer claimed that the brakes were properly maintained and that the crash was due to operator error.
Skip Pita then methodically deposed Blanco Transfer’s chief mechanic and owner, who demonstrated that he knew next to nothing about maintaining trailer brakes. Following that deposition, PWD gave the liability carrier a deadline to pay the $1 Million liability policy. The carrier complied.
Although PWD cannot bring Mr. Exposito back, we did prove Mrs. Exposito right — her husband was a good driver. And PWD obtained justice for the family. We were honored to represent Mrs. Exposito in her quest to get to the truth.
