PWD Recovers $550,000.00 for Pompano Pedestrian
In August 2019, Joe Smith (footnote real name not used) was walking to work in Pompano Beach when he was hit by a automobile. The impact was at a relatively low speed. In fact, Mr. Smith did not believe that his injuries were that bad while on the scene. Neither police nor fire rescue were called to the scene. But several hours later, Mr. Smith really began to feel the full impact of his injuries. During the evening, Mr. Smith went to the Emergency Room and learned that he had sustained injuries to his legs and arm.
After PWD filed suit on Mr. Smith’s behalf, the Defendants took the position that Mr. Smith was partially to blame for causing the collision. In part, Defendant argued that the impact happened at a time in the morning when it too dark for the driver to see Mr. Smith. In response, PWD had its investigator videotape and photograph the area of the incident exactly 1 year from the date of the impact. Through investigation, PWD and its investigator determined that the crash occurred during “civil twilight,” which is time before sunrise but when it is light enough to see without the use of artificial light.
Through the Court Ordered Mediation and non-binding mediation, PWD obtained a settlement of $550,000 on behalf of Mr. Smith. Although, Mr. Smith continues to work towards overcoming his injuries, he has returned to working full time in an industry that provides an invaluable service to society – particularly these days with the Pandemic.
