Trial and Jury Verdict Against Carrabba’s and Shopping Center
For many years, MK had frequented a Boynton Beach Carrabba’s for its 2-for-1 happy hour. One September evening in 2010, MK was walking out of the restaurant when the heel of her shoe became wedged in a gap between two concrete slabs. It turned out that the expansion joint material had disintegrated over time and was never properly maintained. The gap – only ½” wide – was wide enough to cause MK to trip and fall. As a result, MK suffered a broken wrist that required surgery and a concussion. Neither Defendant offered to settle the case for more than $25,000.00 before trial. After a multiple day trial, the Jury awarded MK $230,000.00 with 20% comparative negligence against the Defendants. Moreover, the Defendants paid $50,000.00 for MK’s costs that included expert witness fees and filing fees.
