A permanent injury is not really defined by Florida law. Most of the time what happens is that a doctor will tell whether or not you sustained a permanent injury. Now, in Florida, you are required to sustain a permanent injury before you can recover money for pain and suffering damages. Usually, the issue of permanency is a hotly contested issue where insurance companies hire their doctors to say you weren’t permanently injured and you have your own doctors who say you were permanently injured and a jury typically making the decision about whether or not, in fact, you sustained a permanent injury.
