Who has to pay jury awarded damages in Florida in excess of their insurance policy limits?

What happens if a jury awards money that exceeds the policy limits of the defendant in that case? Good question. Two couple of things will happen. First, we can go after the defendant themselves for that money assuming they’re collectible.
The second thing that can happen is if the insurance company will behave what we call “bad faith” and did not protect their insured, the defendant, behaved wrong somehow during the course of litigation then we go off the insurance company for behaving a bad faith and collect that excess money that way.
